SBF Lawyer: 50-year sentence belongs to the “Medieval” concept of punishment

The lawyer representing the founder’s proposal to sentence up to 50 years in prison, said the “medi-era” view of punishment does not accurately reflect the seriousness of his crimes.

On March 19, Bankman-Fried’s lawyers, Marc Mukasey and Torrey Young, wrote to Judge Lewis Kaplan in response to the government’s March 15 sentencingsuggestion.

“This memorandum is clearly hostile, distorting reality in support of its valuable ‘loss’ narrative and shaping Sam into a fallen super villain.”

On March 15, U.S. attorneys filed more documents and a sentencing memorandum proposing a 40-50-year prison sentence for the former cryptocurrency billionaire, who was convicted in November 2023 on fraud and money laundering charges.

Lawyers claim that the proposed verdict adopts a “medi-century perspective on punishment to achieve a sentencing recommendation equivalent to a death penalty in prison.”

“It’s not justice,” they added, proposing a five to six-year commutation.

Lawyers have made several arguments to justify Bankman-Fried’s commutation of sentence.

They argued that there was no actual loss because the bankruptcy proceedings would result in compensation from all clients and lenders and that the assets remained in the estate.

The two also questioned the government’s claim that Bankman Fried’s risk of re-offending, citing studies on low re-offending rates for educated, white-collar offenders with no criminal record.

Finally, Bankman Fried’s lawyers accused the prosecutor of making baseless charges, including accusation of Bankman Fried of evading responsibility and misrepresenting sentencing data in similar fraud cases.

They said:“We have not identified a federal defendant who has been sentenced to 40 to 50 years in prison for nonviolent crimes and has been released.”

“It is not necessary to crush Sam in this way.”

Mukassi and Young claim Bankman Fried has lost “almost everyone and everything” in his personal and professional life, and recommend a commutation of sentence of about five to six and a half years.

“If the government does think that Sam should ‘regain freedom’, then a significant reduction in the correct guidance range of 63 to 78 months is needed.”

Nearly a year after FTX collapsed, the jury trial concluded that SBF was guilty of all seven charges filed by the U.S. government.
