Consensys sued the SEC to try to classify Taifang as securities

Ethereum developer Consensys has filed a lawsuit against the US Securities and Exchange Commission to counterattack the company’s so -called federal regulatory agencies’ “illegal seizures” to Ethereum.

The company hopes that the Federal Court announced that Ethereum (ETH) is not a securities. Any investigation based on ETH is a securities -based view of Consensys.Securities.According to federal law, Metamask’s pledge service does not violate securities laws and law enforcement operations related to the SEC survey or on Metamask or pledge function.

In the lawsuit filed by the SEC and all five members on Thursday, Consensys revealed thatIt received the SEC Wells notification on April 10, indicating that it intends to take law enforcement operations against the company’s violation of securities law through its Metamask wallet products.Consensys denied that he was a broker and said that the wallet was “simple and interface”.

The complaint also added,SEC violates its past statement against Ethereum’s infringement power, that is, cryptocurrencies are a commodity, not securities (quoting the previous directors Bill Hinman’s 2018 speech), and also violated the SEC’s sister regulatory agency commodity futures trading committee.(CFTC) has the authority of Ethereum.

Consensys claimed in the lawsuit that it “established its own business in the context of this regulatory consensus”, and SEC’s new power of Ethereum (it is called a “big change”) “violation of fair constitutional requirements”Essence

A representative of the US Securities and Exchange Commission refused to comment on the lawsuit.

The lawsuit also depends on the “major issue principle”, that is, a ruling of the Supreme Court prohibits federal regulatory agencies from significantly exceeding the scope of Congress authorization.In the debate proposed by Terraform Labs and Coinbase, the two judges have rejected the view that cryptocurrencies belong to this issue.

Consensys filed a lawsuit with the District Court of the North District of Texas, and joined the ranks of groups such as blockchain associations and companies such as LEGIT Exchange.Securities.
